1. Acceptance of Terms

By accessing and using RealStatify's services, you accept and agree to be bound by the terms and provision of this agreement. These Terms of Service constitute the entire agreement between you and RealStatify Private Limited.

2. Services Description

RealStatify provides professional LiDAR drone survey services including but not limited to:

• Topographic mapping and terrain analysis
• Infrastructure inspection and monitoring
• 3D modeling and BIM integration
• Construction progress monitoring
• Flood risk assessment and modeling
• Forestry and agricultural surveys

3. Service Delivery and Timeline

Service delivery timelines are estimates and may vary based on project complexity, weather conditions, regulatory approvals, and other factors. We will make reasonable efforts to meet agreed-upon timelines but shall not be liable for delays beyond our reasonable control.

4. Pricing and Payment Terms

Service fees are quoted based on project scope, area coverage, and specific requirements. Payment terms will be specified in individual service agreements. Late payments may incur additional charges as specified in the service agreement.

5. Data Ownership and Usage Rights

Raw data collected during surveys remains the property of RealStatify. Processed deliverables and final outputs are licensed to the client for their intended use. Redistribution or commercial use of RealStatify's data without permission is prohibited.

6. Confidentiality and NDA

All project information, data, and communications are treated as confidential. RealStatify maintains strict confidentiality protocols and can execute separate Non-Disclosure Agreements (NDAs) when required by clients.

7. Regulatory Compliance

All drone operations comply with DGCA (Directorate General of Civil Aviation) regulations and other applicable local, state, and national laws. Clients are responsible for obtaining any necessary permissions for survey areas on their property.

8. Limitation of Liability

RealStatify's liability for any claims arising from our services shall be limited to the amount paid for the specific service. We shall not be liable for indirect, incidental, or consequential damages.

9. Service Warranties

We warrant that our services will be performed with reasonable care and skill. Specific accuracy requirements and tolerances will be defined in individual project agreements. No warranties are provided for external factors affecting data quality.

10. Intellectual Property

RealStatify retains ownership of methodologies, software, and processes used in service delivery. Clients receive usage rights to deliverables but not ownership of underlying intellectual property.

11. Force Majeure

RealStatify shall not be liable for delays or failures in performance caused by events beyond our reasonable control, including but not limited to weather conditions, regulatory restrictions, or technical failures.

12. Termination

Either party may terminate service agreements with appropriate notice as specified in individual contracts. Early termination may result in charges for work completed and costs incurred.

13. Dispute Resolution

Any disputes arising from our services shall be resolved through good faith negotiations. Unresolved disputes may be subject to arbitration or legal proceedings as specified in service agreements.

14. Governing Law

These terms and conditions are governed by the laws of India. Any legal proceedings shall be conducted in the courts of Bangalore, Karnataka.

15. Modifications

RealStatify reserves the right to modify these Terms of Service at any time. Updated terms will be posted on our website and become effective immediately for new projects.
